Does Disparate Impact Apply to Age Discrimination Claims by Job Applicants?
An interesting case is making its way through federal court after initially being dismissed at the early stages by a district court judge. The case is Kleber v. CareFusion. The plaintiff, 59-year-old Dale Kleber, is an attorney in the Chicago-area. Mr. Kleber has extensive experience in the legal and professional world, serving as the chief executive officer of a trade association and practicing law for many years. But around 2011, Mr. Kleber’s luck was not so good; he had been out of work for a while and began the process of seeking other employment. In 2014, after unsuccessfully applying to more than 150 jobs, he saw an advertisement for a job posted by a medical technology company called CareFusion. The advertisement was for the position of “Senior Counsel, Procedural Solutions” and sought applicants with “3 to 7 years (no more [...]
Remembering Cheri Hass
It is hard to believe it has been five years since Cheri passed away. We think of her often and remember the many good times we shared and the special way she touched so many lives. Cheri liked most people and loved all animals. We will donate a gift to the Delaware County Humane Society in her honor and know that her many friends and clients are thinking of her today, with some laughter and a lot of sadness, as we are. She will always have an impact on those she touched.

Judge Rules President Trump’s Blocking of Twitter Users is Unconstitutional
A federal judge of the Southern District of New York held that President Trump violated the First Amendment by “blocking” individuals from his @realDonaldTrump twitter account in response to the political views expressed by those individuals. The lawsuit was brought by several twitter users who were blocked from viewing or replying to the President’s tweets after expressing political views critical of the President. Knight First Amendment Inst. at Columbia Univ. v. Trump, S.D.N.Y. , 2018 U.S. Dist. LEXIS 87432 (May 23, 2018). The judge found that President Trump uses the account in his capacity as a public official, not a private individual, as he uses the account for governmental functions. Further, the judge found that the President’s twitter account constituted a designated public forum, and that by blocking individuals based on their political speech, the President violated the First Amendment [...]
